These terms cover your use of Mind Fuse subscription products, including Elevat3 and StampFuse. By creating an account or paying for a subscription, you agree to them.
These Terms of Service form a binding agreement between you and Mind Fuse Inc (also referred to as "we", "us", or "Mind Fuse"), a software company with offices in California, USA and Dubai, UAE. By signing up for an account, accessing a product, or paying for a subscription, you agree to these terms. If you are using the service on behalf of a company, you confirm that you have authority to bind that company.
You must provide accurate, current information when you register and keep it up to date. You are responsible for activity under your account and for keeping your credentials secure. Notify us promptly at [email protected] if you suspect unauthorized access.
Accounts are for users aged 18 or older. Each subscription seat is for a single named user unless the plan explicitly permits team access.
Mind Fuse products are sold as recurring subscriptions billed monthly or annually in US dollars (USD). When you start a subscription you authorize Mind Fuse and our payment processor, Stripe, to charge your payment method on the cycle you selected.
Some plans include a free trial (typically 14 days). You will not be charged during the trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan and the payment method on file will be charged for the first billing period.
You can cancel a subscription at any time from your account dashboard or by emailing [email protected]. Cancellation takes effect at the end of the current billing period. You retain access through that period and are not billed again.
Our refund and cancellation terms are described in our Refund Policy. As a default, we do not provide prorated refunds for unused time in a current billing period. Refunds are considered case by case for billing errors, duplicate charges, or extended technical outages.
You agree to use Mind Fuse products in compliance with our Acceptable Use Policy. You may not resell access to the service, scrape it at scale, reverse engineer or attempt to derive source code, interfere with security, or use the service to violate any law or third-party right.
Mind Fuse and its licensors own all rights, title, and interest in the software, branding, documentation, and underlying technology of our products. We grant you a limited, non-exclusive, non-transferable, revocable license to use the service for the duration of an active subscription, subject to these terms.
You may not remove proprietary notices, copy or distribute the software, or use Mind Fuse trademarks without written permission.
You retain ownership of any data, files, prompts, designs, signatures, or other materials you upload or create using the service ("Your Content"). You grant Mind Fuse a limited, worldwide license to host, process, transmit, and display Your Content solely to operate, maintain, and improve the service for you. We do not sell Your Content and we do not use it to train third-party models without your explicit consent.
You are responsible for having the rights and permissions necessary to use Your Content with the service.
The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Mind Fuse disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or fully secure, or that any AI outputs will be accurate or fit for a specific purpose.
To the maximum extent permitted by law, Mind Fuse will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Mind Fuse's total aggregate liability for any claim arising out of or relating to the service or these terms is limited to the amount you paid Mind Fuse for the affected subscription in the 12 months before the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless Mind Fuse and its officers, employees, and agents from any third-party claims, damages, liabilities, and reasonable legal fees arising from your use of the service, Your Content, or your breach of these terms or the Acceptable Use Policy.
You may terminate your account at any time by cancelling your subscription. We may suspend or terminate your account if you materially breach these terms, fail to pay, or misuse the service in a way that risks harm to others. Sections that should survive termination by their nature (payment obligations, IP, disclaimers, liability, indemnification, governing law) will do so.
These terms are governed by the laws of the State of California, USA, without regard to its conflict of laws principles. Venue for any matter that proceeds in court will lie in the state or federal courts located in Los Angeles County, California.
Before filing a formal dispute, the parties agree to attempt informal resolution by contacting [email protected] and engaging in good-faith discussions for at least 30 days. If informal resolution fails, any remaining dispute will be resolved by binding individual arbitration administered under the rules of the American Arbitration Association, except for small-claims actions and claims for injunctive relief, which may proceed in court.
We may update these terms from time to time. If we make material changes, we will notify you by email or by a notice in the product at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance.
